The staffing agency complies with PF, ESIC, and payroll; the Principal Employer complies with CLRA requirements.
Under the CLRA, if the Contractor fails to pay PF, ESIC, wages, or other statutory dues to contract workers, the Principal Employer is directly liable to pay those dues. Principal Employer liability is a significant risk in off-role arrangements and requires careful contractor selection and monitoring.
CLRA registration as a Principal Employer is compulsory for establishments employing 20 or more contract workers. Contractors employing 20 or more workers must obtain a licence. Some states have a lower threshold. The CLRA does not apply to contract labour engaged in perennial core business activities in some contexts.
