The renewal application is filed in Form TM-R, accompanied by the prescribed renewal fee. The application can be filed within one year before the date of expiry, or within six months after the expiry with a surcharge. If the renewal is not filed even within the six-month grace period, the trademark is removed from the Register. A removed mark can still be restored on payment of the prescribed restoration fee within one year of removal under Section 25(4), but this is a discretionary remedy and is not guaranteed.
