Trademark registration in India is the legal process by which a brand's word, logo, slogan, shape, or other distinctive element is recorded in the Register of Trade Marks maintained by the Trade Marks Registry under the Trade Marks Act, 1999. Once registered, the trademark gives the proprietor an exclusive statutory right to use the mark in the registered classes of goods or services and to take infringement action against anyone using identical or deceptively similar marks for related goods or services anywhere in India.
The registration process begins with a public-records search on the Trade Marks Registry database to check whether identical or similar marks are already registered or applied for in the relevant classes. The application is filed in Form TM-A under one or more of the 45 classes under the Nice Classification — Classes 1 to 34 cover goods and Classes 35 to 45 cover services. After filing, the application is examined by the Registrar; if any objection is raised under Section 9 (absolute grounds) or Section 11 (relative grounds), a written reply and often a show-cause hearing follow. Once the objection is overcome, the mark is published in the Trade Marks Journal for opposition, and if no opposition is filed within four months, registration is granted.
