The Shop and Establishment Act is a state-level labour law enacted by every Indian state to regulate the conditions of work, hours of operation, wages, leave, holidays, and other terms of service for persons employed in shops, commercial establishments, restaurants, theatres, and other places of work. Every shop or establishment commencing business in a state is required to apply for registration under the relevant Shop and Establishment Act of that state within a prescribed period — typically 30 to 60 days from the date of commencement.

Although each state has its own Shop and Establishment Act, the broad framework is similar across states. The application is filed with the local Labour Department or Municipal Corporation — in Maharashtra, the registration is known as the Gumasta licence and is issued by the Municipal Corporation. The certificate is required for opening a current account in a bank, for GST registration on commercial premises, for FSSAI for food establishments, and for compliance with EPF and ESI laws. The Shop Act registration must be renewed periodically and amendments must be filed on change of name, address, or nature of business.
