HNI Succession Planning — Multi-Generational Wealth Preservation
A High-Net-Worth family with multi-city real estate, large equity portfolios, and a controlling business interest had no formal distribution roadmap. We built an irrevocable trust structure that ring-fenced the estate and bypassed years of probate delay.
A complex estate with no roadmap for transition.
The family's asset base spanned multi-city real estate, significant equity portfolios, and a controlling interest in a private enterprise — yet there were no formal distribution protocols. The absence of a structured roadmap exposed the family to potential litigation and the arduous probate requirements of Indian succession laws. Without a clear transition mechanism, the estate was vulnerable to fragmentation, tax inefficiencies on transfer, and operational instability for the underlying business holdings.
How we structured the transition.
Irrevocable Family Trust
We established an Irrevocable Private Family Trust under the Indian Trusts Act, 1882, to ring-fence assets from future personal creditors.
Family Constitution
We drafted a comprehensive Family Constitution to codify governance and aligned it with the Trust Deed for a unified framework.
Tax-Optimised Transfer
We optimised the transfer of securities to avoid adverse "deemed income" under Section 56(2)(x) of the Income Tax Act.
Probate Bypass
We formalised a residuary Will and passed board resolutions recognising the Trust as successor in interest, bypassing 12–24 month probate delays.
The capabilities we brought to bear.
Trust & Estate Structuring
Irrevocable Private Family Trust drafted under the Indian Trusts Act, 1882.
Governance Frameworks
Family Constitution codifying succession, control, and distribution rules.
Transfer Tax Planning
Securities moved without triggering deemed income under Section 56(2)(x).
Business Continuity
Board resolutions recognising the Trust as successor to the enterprise.
The results we delivered.
Proactive succession planning is a business necessity that ensures the hard-won stability of an enterprise is not dismantled by the personal complexities of estate transition.
